These Terms and Conditions (as may be amended from time to time, the “Agreement”) is an agreement between you, the Agent, Retailer, user or beneficiary of this Service who is at least 14 years of age (“M/s. Eligibility Criteria –

The Services are not available to persons under the age of 18 or to anyone previously suspended or removed from the Services by SCPL Portal. By accepting these Terms and Use or otherwise using the Services or the Site, you represent that you are at least 18 years of age and have not previously been suspended or removed from the Services. You represent and warrant that you have the right, authority and capacity to enter into this Agreement and to abide by all of the terms and conditions of this Agreement. You will not impersonate any person or entity, or falsely state or otherwise misrepresent the identity, age or affiliation with any person or entity.

Enforcement of Terms and Conditions

Not with standing any principles of conflicts of law, these Terms and Conditions are governed by and interpreted in accordance with the laws of India. If any part of these Terms and Conditions is held to be illegal, void or unenforceable, that part shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions. SCPL may revise these Terms and Conditions at any time by updating this posting. SCPL may terminate this Agreement at any time upon notice for any reason. User may terminate this Agreement by destroying all Materials obtained from the SCPL Site.

General Terms

The logos, brand names and trademarks used in the website are the property of their respective owners. Beam assumes no liability for any statements, representations and/or claims made by related companies/individuals regarding their products, services and/or offers being made; AND THE MAXIMUM LIMITATION OF DAMAGES IS LIMITED TO THE CONSIDERATION PAID FOR SUCH PRODUCTS AND OR SERVICES.

My Wallet Terms of Use

The amount paid for loading the advance payment into the Customer’s account (“My Wallet”) opened by the person registering as an SCPL Swechchha Kendra customer for availing various SCPL swechchha kendra services. The amount paid to load My Wallet is neither the amount credited to SCPL Account; Nor can the amount loaded in My Wallet be withdrawn on demand. Please retain the advance payment voucher for future reference. SCPL swechchha kendra assumes no liability for theft, loss, loss, misuse or mutilation of any kind. Within 24 months from the date of opening My Wallet, it can be automatically renewed by SCPL swechchha kendra in units over a period of 24 months, unless terminated by SCPL swechchha kendra Customer or SCPL swechchha kendra. If the balance in My Wallet remains unused for a period of 24 months at the rate of 5% p.m. Price, service charges, text and validity etc. are subject to change by SCPL swechchha kendra without notice, thereafter the said amount will lapse.

Termination Clause-

We may immediately terminate or suspend your account and block access to the Service, in our sole discretion, without prior notice or liability, for any reason and without limitation, including for breach of the Terms is but not limited to these. If you wish to terminate your account, you may discontinue using the Service. All provisions of the Terms which by their nature should survive termination shall survive termination, including without limitation, proprietary provisions, warranties. Governing Law –

These Terms shall be governed by and construed in accordance with the laws of India, which governing law applies to the Agreement without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of those rights. If any provision of these Terms is held by a court to be invalid or unenforceable, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us in relation to our Service and supersede and replace any prior agreements between us in relation to the Service.

Change in Service –

We reserve the right to withdraw or modify our Service and any services or content provided through the Service at our sole discretion without prior notice. We shall not be liable if all or any part of the Service is unavailable at any time or for any period for any reason. From time to time, we may restrict access to parts of the Service or all of the Service for Users, including registered users.

License and Ownership

Any and all intellectual property rights (“Intellectual Property”) associated with the Digital Presence and its content (“Content”) are the sole property of SCPL, its successors and assigns. The Content is protected by copyright and other laws in India and other countries. Elements of the SCPL digital presence are also protected by trade dress, trade secret, unfair competition and other laws and may not be copied or imitated in whole or in part. All custom graphics, icons and other items appearing on the SCPL Digital Presence are trademarks, service marks or trade dress (“Marks”) of SCPL, its affiliates or other entities that granted SCPL the right and license to use such Marks Is. It may not be used or interfered with in any manner without the express written consent of SCPL. Except as expressly authorized by these Supplemental Terms of Use, you may not copy, reproduce, modify, lease, loan, sell, create derivative works from, upload, transmit or distribute the Intellectual Property of SCPL Digital Presence in any way can do. prior written permission of SCPL or the appropriate third party. Except as expressly provided herein, SCPL does not grant you any express or implied rights to any intellectual property of SCPL or any third party. Suspension of Services –

SCPL reserves the right to suspend/discontinue SCPL Wallet Services to you at any time, for any reason, including but not limited to the following:

a. For any suspected violation of the rules, regulations, orders, directions, notifications issued by RBI from time to time or for any violation of the Terms and Conditions mentioned in these T&C;

b. For any suspected discrepancy in the details, documentation or enrolment form provided by you;

c. To deal with potential fraud, sabotage, wilful destruction, threat to national security or any other unforeseen reasons etc.;

d. If it is due to technical failure, modification, upgradation, alteration, relocation, repair and/or maintenance due to an emergency or any technical reason.

e. If it is due to any transmission deficiency caused by topographical and geographical constraints/limitations;

f. If the mobile connection to which your SCPL Wallet is linked becomes non-functional or is no longer in your possession or control.

g. If SCPL believes that, in its reasonable opinion, termination/suspension is necessary.

Disclaimer of Warranties

SCPL makes no representations regarding the results that may be obtained from the use of the SCPL digital presence, SCPL systems, services, purchase of SCPL services, use of my wallet, information or content. Its use is at your own risk.

SCPL digital presence, SCPL systems, information, services, purchase of SCPL services, use of my wallet and content are provided on an “as is” basis. SCPL, its licensors, affiliates and its suppliers, to the fullest extent permitted by law, disclaim all warranties, whether express or implied, statutory or otherwise, including the implied warranties of merchantability, non-infringement of third party rights, but not limited to these. , and fitness for a particular purpose. SCPL and its affiliates, licensors and suppliers make no representations or warranties regarding the accuracy, completeness, security or timeliness of content, information or services provided on or through the use of SCPL digital presence or SCPL systems, purchase of SCPL services let’s give and/or use of my wallet. No information obtained by you from SCPL digital presence shall create any warranty not expressly stated by SCPL in these supplemental terms of use.

Some jurisdictions do not allow limitations on implied warranties, so the limitations and exclusions of this section may not apply to you. If you are acting as a consumer, your statutory rights which cannot be waived, if any, will not be affected by these provisions. You agree and acknowledge that the limitations and exclusions of liability and warranties provided in these terms of use are fair and reasonable.

Limitation of Liability

To the extent permitted by applicable law and to the extent that SCPL is otherwise found liable for any damages, SCPL is only liable for actual damages up to the actual cost of the services paid. To the extent permitted by law, in no event shall Beam, its affiliates, its licensors, its suppliers or any third party mentioned in the SCPL Digital Presence be liable for any incidental, indirect, exemplary, punitive and consequential damages, lost profits, or will not be liable. damages resulting from lost data or business interruption resulting from the use or inability to use SCPL Digital Presence, SCPL systems, information, services or materials, whether based on warranty, contract, tort, libel, or any other legal theory, and whether SCPL has been informed of the possibility of such loss. To the extent permitted by law, the remedies granted to you in these Supplemental Terms of Use are exclusive and limited to the remedies expressly provided in these Supplemental Terms of Use.

Modification of this Agreement

SCPL  reserves the right to change, modify, add, or remove portions of this Agreement (each, a “change”) at any time by posting notification to the SCPL  website www.scinfotech.in or otherwise communicating the notification to You. The changes will become effective, and shall be deemed accepted by You, 24 hours after the initial posting and shall apply immediately on a going-forward basis with respect to payment transactions initiated after the posting date. If You do not agree with any such modification, your sole and exclusive remedy is to terminate your use of the services. For certain changes, SCPL  may be required under applicable law to give you advance notice, and SCPL will comply with such requirements.

Refund Policy

Unless otherwise agreed in writing, the SCPL-Retail agrees to give a onetime non-refundable deposit to the Company for enrolling the SCPL-Retail and setting him up as a registered SCPL – Retail of the Company. His area of work includes distributing specified banking products /services through Computer System where SCPL will provide Link with login ID and Password or through Internet or email ID. This deposit shall be non-refundable and is a charge towards setting up costs of specified banking operations by SCPL- Retail.
